Terms of Service

These Terms of Service ("Terms") govern your use of the Hypervex Code GitHub App, website at hypervex.ai, and dashboard (collectively, the "Service"). The Service is operated by Prasanth Kannan, India ("Hypervex", "we", "us").

By installing the Hypervex GitHub App, creating an account, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not install or use the Service.

Hypervex Code is an AI-powered security code review tool that integrates with GitHub. When you open a pull request on a connected repository, Hypervex analyses the PR diff and relevant codebase context and posts structured security findings as a PR comment.

AI disclosure. Reviews are generated using large language models — currently Claude by Anthropic. Findings represent probabilistic assessments. They may include false positives (issues flagged that are not real) and false negatives (real issues not found). Hypervex findings are intended to assist your engineering and security process, not to replace it. Hypervex does not provide certified security audits, penetration testing, or compliance assessments.

Installing Hypervex grants the GitHub App: • Read access to code and repository metadata for repositories you select. • Write access to post comments on pull requests. • Read access to pull request metadata and events.

You can revoke access at any time from your GitHub account settings under "Installed GitHub Apps". Uninstalling stops all processing of new events and queues deletion of your codebase context index within 30 days.

You must have a GitHub account in good standing to use Hypervex. You are responsible for all activity that occurs under your account. You must not share your account credentials or allow others to use your account.

Notify us immediately at admin@hypervex.ai if you suspect that your account has been accessed without authorisation.

You may use Hypervex only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service to analyse code you do not own or do not have explicit authorisation to analyse. • Attempt to circumvent, reverse engineer, or exploit the AI models, APIs, or infrastructure underpinning the Service. • Submit code or data that contains malware, exploits, or material designed to harm the Service or other users. • Use the Service in any way that violates applicable laws or regulations, including export control and data protection laws. • Resell, sublicense, or otherwise make the Service available to third parties as a standalone product. • Interfere with the operation of the Service or attempt to gain unauthorised access to any part of it.

We reserve the right to suspend or terminate accounts that violate these rules.

Free tier. Includes one connected repository and up to 10 security reviews per month. No payment method required.

Pro tier. $19 USD per month. Includes unlimited connected repositories, up to 100 security reviews per month, and the Trace investigation pass for high-confidence findings.

Billing. Pro tier subscriptions are billed monthly through Polar (polar.sh), our payment processor. Polar acts as the merchant of record. Their terms of service and privacy policy apply to payment processing. You will receive a billing receipt from Polar for each charge.

Cancellation. You may cancel your Pro subscription at any time from your Hypervex dashboard. Cancellation takes effect at the end of the current billing period; you will retain access to Pro features until then.

Refunds. We do not offer refunds for partial months, except where required by applicable consumer protection law.

Changes to pricing. We will give at least 30 days' notice before changing subscription prices. Notice will be sent to the email address associated with your account.

Your code. You retain all ownership rights in the code, repositories, and content you submit to or analyse through the Service. By using the Service you grant Hypervex a limited, non-exclusive licence to process your code solely for the purpose of providing the Service (generating security findings, building your codebase context index). This licence terminates when you uninstall the App or delete your account.

AI findings. Security findings, review comments, and reports generated by Hypervex are provided to you under a perpetual, non-exclusive, royalty-free licence for any lawful purpose.

Hypervex platform. The Hypervex software, platform, name, logo, and brand are owned by the Operator and protected by applicable intellectual property law. You may not use the Hypervex name or brand without written permission.

Our Privacy Policy at hypervex.ai/privacy describes how we collect, use, and protect your data and is incorporated into these Terms by reference. By using the Service you consent to the data practices described in the Privacy Policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM SECURITY VULNERABILITIES. WE DO NOT WARRANT THAT ANY SECURITY FINDINGS ARE ACCURATE, COMPLETE, OR EXHAUSTIVE.

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HYPERVEX'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO HYPERVEX IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

IN NO EVENT SHALL HYPERVEX BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.

You agree to indemnify, defend, and hold harmless Hypervex and the Operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any rights of a third party.

Either party may terminate this agreement at any time. You may terminate by uninstalling the GitHub App and deleting your account. We may suspend or terminate your account immediately if you violate these Terms or if we are required to do so by law.

Upon termination: your right to use the Service ceases immediately; your data will be handled in accordance with the Privacy Policy retention schedule; any outstanding Pro subscription will be cancelled by Polar.

Sections 7 (Intellectual Property), 9 (Disclaimer), 10 (Limitation of Liability), 11 (Indemnification), and 13 (Governing Law) survive termination.

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in India.

If you are a consumer located in the European Union, you may also be entitled to bring a claim in the courts of your country of residence.

Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Hypervex regarding the Service and supersede all prior agreements.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.

No waiver. Failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

We may update these Terms from time to time. When we make material changes we will update the effective date and notify you by email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
